I. General provisions

  1. These Terms of Service set out the rules for:
    1. creating and maintaining a User Account;
    2. providing Hosting Services under the FREE, PRO and VIP plans;
    3. registering, transferring, maintaining and renewing Domains;
    4. providing VPS Services, SSL services and Additional Services;
    5. placing Orders, making payments, activating Services and submitting complaints;
    6. posting and storing content within the CBA.pl infrastructure.
  2. The Service Provider is ABC Hosting Ltd., with its registered office in Belize at 7B Neal Pen Road, Belize City, registration number 148 538, DUNS 81-542-7447, operating under the CBA.pl brand.
  3. Correspondence address: ul. Świętokrzyska 30 lok. 63, 00-116 Warsaw, Poland.
  4. CBA.pl may be contacted:
    1. via the form or ticketing system available in the User Panel;
    2. by email at obsluga@cba.pl;
    3. by post at the current correspondence address specified in the Terms of Service.
  5. The Terms of Service are made available free of charge before an Account is created and before an Order is placed, in a form that enables them to be saved, reproduced and printed.
  6. The User is bound by the version of the Terms of Service made available to them before entering into the Agreement, subject to subsequent amendments introduced in accordance with Chapter XIV.
  7. The price list, Service parameters, period of provision and detailed scope specified in the offer and the Order summary form part of the Agreement concerning the given Service.
  8. In the event of a conflict between the Terms of Service and individually agreed Order terms, the individually agreed terms shall prevail, provided that they do not infringe the User's mandatory rights.

II. User Account and account data

  1. Use of Services that require the User to be identified requires the creation of an Account or signing in by means of an available login method.
  2. The User is required to provide true, current and complete data and to update them when they change.
  3. CBA.pl may require confirmation of an email address, telephone number or other data where this is necessary to:
    1. secure the Account;
    2. perform an Order;
    3. meet the requirements of a Domain registry operator, payment operator or applicable law;
    4. prevent abuse.
  4. CBA.pl requires verification of the Polish telephone number provided by the User. Mobile numbers are verified using a one-time SMS code, while landline numbers are verified manually by CBA.pl support at the User's request. Applicable limits on the number of SMS messages and retry attempts are displayed in the User Panel.
  5. The User is responsible for keeping their login credentials confidential and should immediately report any suspected takeover of the Account.
  6. CBA.pl may temporarily restrict access to an Account where this is necessary to protect it, investigate suspected abuse or comply with a legal obligation. Where legally and technically possible, CBA.pl will inform the User of the reason and the means of regaining access.
  7. The mere creation of an Account does not constitute consent to receive commercial information or to the processing of data for purposes not required to provide the Services. CBA.pl may process data necessary to create an Account, enter into and perform an Agreement, register and maintain a Domain, process payments, ensure security and comply with legal obligations on the appropriate legal basis, without obtaining separate consent where consent is not required. Separate, voluntary consent is required only for those purposes or processing methods for which the obligation to obtain it arises under law, in particular the sending of commercial information where there is no other legal basis. The scope of processed data, purposes and legal bases are specified in the Privacy Policy.
  8. The User may submit a request to close the Account. Closing the Account does not result in deletion of data that CBA.pl must retain to perform or settle the Agreement, handle claims or comply with a legal obligation. Details are set out in the Privacy Policy.
  9. The sale, rental or lending of a User Account and of names made available to the User in the cba.pl and j.pl subdomains is prohibited. This provision does not exclude transfers carried out by CBA.pl in accordance with the Terms of Service.

III. Entering into an Agreement and placing Orders

  1. Information presented on offer pages constitutes an invitation to place an Order unless expressly stated otherwise.
  2. Immediately before placing an Order, the User receives a summary covering the selected Services, their main features and the total price including taxes and mandatory charges. The summary also includes selected Additional Services. The period for which a Service is provided is specified in the selected offer or in the Terms of Service; not every item in the summary contains a separate indication of that period. In the case of a paid Order, the Consumer receives clear and prominent information about the duration of the Agreement immediately before placing it.
  3. A single Order may include several Services, including a Hosting Service, Domain, VPS, SSL and an Additional Service. Each item retains its own scope and the period of provision applicable to it or its one-off nature, as follows from the selected offer and the provisions of the Terms of Service concerning that Service.
  4. An Order with a total value of 0 is confirmed without redirection to an external payment operator. The Service is activated after the activation confirmation button is used and the eligibility conditions have been successfully verified.
  5. A paid Order is accepted for performance after payment has been successfully confirmed, unless the offer provides for a different activation time.
  6. Once the Order has been accepted for performance and the activation conditions have been met, CBA.pl launches the Service within the time applicable to its type. Activation of the Service is not conditional upon a separate email confirming its launch being sent.
  7. If the price, availability or parameters of a Service change before the Order is finally placed, the User will receive an updated summary and may accept the change or refrain from placing the Order.
  8. The User may not place an Order using data, a payment instrument, a Domain or an Account that they are not authorised to use. This prohibition does not exclude financing another person's Hosting Service under paragraph 9.
  9. Placing an Order requires a User Account and signing in to the Panel, except where another person's Hosting Service is financed through the donation feature made available by CBA.pl. This feature allows a third party to pay for the activation or renewal of a Hosting Service assigned to another User's Account without signing in to that Account. Payment for the Service does not change the User to whom the Account belongs or transfer the Service to the financing person. By virtue of providing the financing, that person does not obtain access to the Account, Panel or data, or any authority to manage the Service.

IV. Hosting Services

  1. A Hosting Service consists in making server resources available, in particular for hosting websites, email, databases and the functions specified in the selected offer.
  2. CBA.pl provides Hosting Services under the FREE, PRO and VIP plans. The current parameters, limits and prices of each plan are presented in the offer and Order summary. A change to the offer for new Orders does not automatically change the parameters of a Service period that has already been paid for.
  3. The FREE Hosting Service may be used only once for a given Account. A User may have no more than one active FREE Hosting Service.
  4. The FREE Hosting Service is provided for 7 days from activation. At the end of this period it is suspended unless the User orders and pays for a PRO or VIP Hosting Service.
  5. The FREE Hosting Service is activated through the standard Order process with a value of 0. CBA.pl may refuse activation if the Account has already used the FREE Hosting Service, the User already has an active Hosting Service or uses Accounts to circumvent this restriction.
  6. A promotion marked as intended for new Users may be used only once by the same person or entity, regardless of the number of Accounts created, unless the terms of the promotion expressly provide otherwise.
  7. At the end of the paid period of a PRO or VIP Hosting Service, the Service is suspended until renewed.
  8. The User may link their own Domain registered with another service provider to the Hosting Service. Within 30 days of adding the Domain to the Hosting Service, the User should set the DNS servers indicated by CBA.pl for that Domain and meet the technical requirements specified in the Panel.
  9. Data transfer under the FREE, PRO and VIP plans is unlimited. The User may not use resources in a manner that threatens the stability or security of shared infrastructure. In the event of such abuse, CBA.pl may restrict the Service to an extent proportionate to the threat, applying the rules in Chapter VI. The amount of data transferred is not in itself grounds for restricting the Service, provided that use of the Service does not threaten the stability or security of the infrastructure.
  10. CBA.pl creates backups as part of operating the Services as an additional data safeguard. Restoration of data may prove impossible due to circumstances for which CBA.pl is not liable under applicable law. We therefore recommend that the User also regularly create and store their own backups outside CBA.pl infrastructure. This provision does not limit CBA.pl's liability for non-performance or improper performance of its backup obligations.
  11. The basic disk-space limit of the VIP Hosting Service is 200 GB, and its email-space limit is 100 GB. The User may increase disk space using upgrades available for their plan: 1 GB and 10 GB packages, and a 100 GB package available exclusively for VIP. Email space may be increased in 1 GB or 10 GB packages. The price and duration of an upgrade are presented before the Order is placed.
  12. The User may increase selected Hosting Service parameters by purchasing upgrades available for that Service in the Panel. Before placing an Order, the User receives information on the scope of the increase, its price and the period for which the upgrade will apply. When the period of the Hosting Service is renewed, purchased upgrades are included in the proposed renewal Order. To opt out of renewing them, the User should contact CBA.pl support before placing that Order.

V. Permitted use of Services

  1. The User may not use the Services for activities that are unlawful, infringe third-party rights or system security, or violate the rules set out in the Terms of Service.
  2. In particular, it is prohibited to:
    1. distribute phishing content, malicious software, including ransomware, code designed to obtain unauthorised access, or content intended to fraudulently obtain data;
    2. operate botnets, mine cryptocurrencies or perform other operations that place an excessive load on the infrastructure;
    3. use the Services for bulk mailing, including newsletters, or to send spam, advertising or commercial offers without the recipient's required consent;
    4. circumvent Service security features, limits or metering mechanisms;
    5. publish content inciting violence or hatred, or store or disseminate unlawful content, in particular child sexual abuse material and other pornographic content whose storage or dissemination is prohibited by law;
    6. unlawfully make available works, broadcasts or other materials protected by intellectual property rights.
  3. An assessment of a report or User activity should take into account the context, credibility of available information, severity of the infringement and the rights and legitimate interests of the persons concerned.
  4. The User is responsible for content and activities carried out using their Account or Service, except in cases for which CBA.pl or a third party is liable under law.
  5. Sending email messages in a manner that does not violate the prohibition on bulk mailing is subject to the message limits specified for the relevant Service. Once the limit is reached, the ability to send further messages is temporarily blocked and restored when the limit permits sending again. Unlimited data transfer does not mean an unlimited number of outgoing email messages.

VI. Reporting illegal content and restricting Services

  1. Any person may report content they consider illegal via the contact form on CBA.pl or at obsluga@cba.pl.
  2. A report should include:
    1. as precise a URL, Domain name or other information enabling the content to be located as possible;
    2. the reasons why the reporting person considers the content illegal;
    3. the reporting person's contact details, unless the law permits a report without providing them;
    4. a statement that the report has been made in good faith and that the information provided is correct and complete.
  3. CBA.pl confirms receipt of the report electronically if the reporting person provided a contact address, and informs that person of the decision taken to the extent required by law.
  4. Depending on the nature and severity of the infringement, CBA.pl may:
    1. request that the User remedy the infringement;
    2. restrict access to specific content;
    3. temporarily restrict a specific Service function;
    4. suspend the Service or Account;
    5. terminate the Agreement in the case of serious, repeated or irremediable infringements.
  5. CBA.pl may immediately suspend a Service containing content that infringes the law, third-party rights or unambiguous provisions of the Terms of Service. Following suspension, CBA.pl informs the User of the grounds for the decision and allows 48 hours to respond or remedy the infringement, unless providing such information is prohibited by law or could impede the actions of a competent authority.
  6. If the User fails to remedy the infringement within the specified time or the explanations do not justify restoring the Service, CBA.pl may terminate the Agreement and delete the Service and its data. Where the Service is blocked or deleted due to a breach of the Terms of Service, fees for the unused period are non-refundable, subject to rights that cannot be excluded.
  7. In the case of content that poses a critical threat or manifestly constitutes a serious infringement of law, in particular phishing or child sexual abuse material, the Service will not be relaunched. The User is not given access to illegal content or copies thereof. CBA.pl preserves, deletes or transfers such data to competent authorities solely to the extent and for the period required by law.
  8. If the User's remaining data are lawful, can be safely separated from the illegal content and their disclosure is not prohibited by law or a competent authority, CBA.pl may enable the data to be downloaded once without relaunching the Service.
  9. Unless prohibited by law, CBA.pl provides the User concerned with reasons for the decision, specifying at least its grounds, scope, duration and the possibility of requesting reconsideration.
  10. The User may challenge the decision via the ticketing system in the Panel or at obsluga@cba.pl. The request should identify the decision and the circumstances supporting its amendment. Submitting a request does not automatically unblock the Service or make available any content whose possession, storage or transmission is unlawful.
  11. CBA.pl is not required to generally monitor all data stored by Users. It may, however, apply proportionate security measures and comply with obligations arising from credible reports and orders of competent authorities.

VII. Registration and maintenance of Domains

  1. CBA.pl enables the registration, transfer and renewal of selected Domains in accordance with the current offer and the rules of the relevant registry operator and registrar.
  2. Before placing an Order, the User receives information on the price, registration or renewal period, and the principal requirements applicable to the selected extension.
  3. The Domain is registered to the User using the data assigned to their Account. The User is required to verify that the data are correct and current before placing the Order. Registration of a Domain to another subscriber within that Account is not available. The required scope of data depends on the extension, type of subscriber and rules of the relevant registry. A User who is a natural person may register Domains only after reaching the age of majority.
  4. Additional data or documents may be required for selected extensions, including date of birth, place of birth, identification number or a document confirming eligibility for registration. CBA.pl will inform the User of the requirement and the time limit for satisfying it before registration or immediately after receiving the registry's request.
  5. If the User fails to provide the required data or documents within the specified time, registration may not be completed or the Domain may be suspended in accordance with the rules of the relevant registry.
  6. Once payment is confirmed, CBA.pl commences the Domain registration process. Its completion depends on the availability of the name, the correctness of the required data, and the operation of the relevant registry and registrar. Domain registration becomes effective when confirmed by the relevant registry. Payment alone does not guarantee the availability or successful registration of the selected name.
  7. If registration cannot be completed, CBA.pl will refund the price received for the unperformed Service using an agreed or available refund method.
  8. Renewal rules, the period after expiry, the possibility of restoring a Domain and any additional fee depend on the extension and are presented in the offer, Panel or renewal notice.
  9. An additional fee of PLN 50 gross is charged for renewing a Domain after its validity period has expired, once for each renewal. If the Domain expired before the Order was placed, the fee is included in the Order summary. If it expires after the Order is placed but before renewal is completed, CBA.pl will inform the User of the additional payment and the time limit for making it. Renewal will take place after the additional payment has been accepted and the full required amount received. If the additional payment is not accepted or made within the specified time, the Order will not be performed and the payment received will be refunded. The possibility of renewing or restoring the Domain depends on the rules and deadlines of the relevant registry. The PLN 50 gross fee does not apply to .j.pl Subdomains.
  10. The AuthInfo code for a .pl Domain is issued promptly at the subscriber's request (download the AuthInfo form), following the necessary verification of entitlement to receive it. For other Domains, issuance of the code and transfer take place in accordance with the rules of the relevant registry and registrar. Assignment of a Domain is handled manually on the basis of a completed and signed form (download the assignment form) sent to CBA.pl at obsluga@cba.pl, together with a copy of an identity document to the extent necessary for verification. CBA.pl specifies the required scope of data and the secure means of transmitting the document. The time limit for reviewing an assignment request is up to 14 business days from receipt.
  11. A User registering a .pl Domain is bound by the current .pl Domain name terms published by NASK. For other Domains, the current rules of the relevant registry and registrar apply.
  12. A Domain may not be transferred, used or registered in violation of third-party rights, the rules of the relevant registry or applicable law.
  13. After successful registration or renewal of a Domain, the fee is non-refundable due to the User changing their decision or ceasing to use the Domain, subject to mandatory provisions of law. The rules governing withdrawal from the Agreement and settlement of the fee are set out in Chapter XI.
  14. At the User's request, CBA.pl may transfer Domains from one CBA.pl Account to another CBA.pl Account belonging to the same User, provided that the person or entity that is the Domain subscriber does not change. This is an internal transfer of Services between Accounts and does not constitute transfer of the Domain to an external registrar or assignment or change of the Domain subscriber.
  15. The transfer Service costs PLN 150 gross for the entire transfer, regardless of the number of Domains covered. The fee is charged before the transfer from the Account from which the Domains are to be transferred is carried out.
  16. If a paid transfer Service has not yet been performed, the User may receive a refund of the price in accordance with the withdrawal and refund rules. Once the transfer has been performed, the fee is non-refundable, subject to rights that cannot be excluded.
  17. The fee also applies where a change of data requires the Domain to be transferred to another Account. A correction of data performed without changing the Account is not a transfer Service.
  18. A name in the j.pl domain is a subdomain belonging to CBA.pl, made available to the User for use solely with an active CBA.pl Hosting Service. It is not a separate Domain registered to the User in an external registry.
  19. A .j.pl Subdomain is registered and renewed for a period of one year. Registration costs PLN 3.90 gross for the FREE plan and is free of charge for the PRO and VIP plans. Renewal costs PLN 19.90 gross. Current prices are also published in the CBA.pl price list.
  20. The User may not change the DNS servers of a .j.pl Subdomain or point it, by changing DNS, to infrastructure other than CBA.pl. Visitors may be redirected from a website served by CBA.pl to another address, including outside CBA.pl. A .j.pl Subdomain may not be transferred to an external registrar. It may, however, be transferred between CBA.pl Accounts as part of the paid transfer Service described in paragraphs 14–17.
  21. If the User does not have an active CBA.pl Hosting Service, a paid .j.pl Subdomain remains assigned to the Account for its validity period, but does not display a website or other Services linked to the Hosting Service.
  22. After a .j.pl Subdomain expires, the User has 30 days to renew it. If that time passes without renewal, the Subdomain may be removed from the Account and made available for registration again.
  23. There is no external operator or external registry terms for .j.pl Subdomains. The CBA.pl offer is the source of current terms and prices.
  24. A subdomain in the form name.cba.pl is made available free of charge solely for use with a CBA.pl Hosting Service. Its DNS servers may not be changed and it may not be transferred to another service provider. At the end of the period of the linked Hosting Service, the subdomain ceases to operate but remains assigned to the User Account for at least one year. After that period it may be removed and made available to another User.

VIII. Technical Services for a Domain

  1. The User may order one of the available technical Services for a Domain they own:
    1. WordPress repair;
    2. malware removal and website security;
    3. CMS update;
    4. performance optimisation;
    5. minor website modification;
    6. ongoing website maintenance.
  2. The Order identifies the Domain to which the Service applies. Before confirming it, the User should verify that the correct Domain has been selected.
  3. The following billing rules apply to technical Services:
    1. The price of the Services listed in paragraph 1 points 1–5 covers one hour of work, which is usually sufficient to perform the Service. Where necessary, CBA.pl agrees the scope of work with the User before commencing it. If the analysis shows that performance requires one or more additional hours of work, before commencing performance of the Service CBA.pl informs the User of the required scope of work and the amount of the additional payment. If the User does not accept it, they may cancel the entire Service and will receive a refund of the full payment made for it, in accordance with paragraph 6.
    2. Ongoing website maintenance is provided until the end of the paid period of the linked Hosting Service and is not paid for in monthly instalments. Where it is activated during the Hosting Service period, the fee is charged for the period remaining until its end, rounded up to full months. The rounding is used solely to calculate the fee and does not extend the period of ongoing maintenance.
  4. The name of a Service category does not imply an unlimited scope of work. The binding scope, price, completion date or period, and the cooperation required from the User follow from the description accepted in the Order and subsequent arrangements concerning performance of the work.
  5. Before commencing performance, CBA.pl may request information, a backup, technical access or other data necessary to perform the Service. Failure to provide the necessary cooperation may result in a corresponding postponement of the completion date.
  6. If the analysis shows that the assignment falls outside the ordered scope, before carrying out any work subject to an additional charge CBA.pl will present the User with a proposed scope extension and the amount of the additional payment. If the User does not accept the proposal, the Order will not be performed and the entire payment received for it will be refunded.
  7. Completion of the Service is confirmed in a ticket, electronic message or another agreed channel.

IX. VPS, SSL and other Additional Services

  1. Current VPS variants, parameters, locations, systems, periods and prices are specified in the offer and the Order summary. VPS activation takes place within 48 hours of payment confirmation.
  2. Additional paid Services may be offered for a VPS, in particular software installation and administrative support. The period and price of an Additional Service are presented separately and may be linked to the VPS period.
  3. If the VPS is not renewed after the end of the paid period, the Service is suspended. Three days after the end of the paid period, the VPS and its data are deleted unless the Service has been renewed in the meantime.
  4. CBA.pl may suspend a VPS that threatens the security or stability of the infrastructure or is used in breach of Chapter V, in accordance with the rules set out in Chapter VI.
  5. The SSL certificate is provided free of charge. The Service covering its activation, operation and maintenance is ordered for a period of one year. It is free of charge under the VIP plan. Under other plans, it may be free of charge or paid, depending on the applicable offer or promotion. The price and renewal terms of this Service are specified in the Order.
  6. CBA.pl handles technical renewals of the SSL certificate for the duration of the Service. The technical validity period of an individual certificate may be shorter than the period of the purchased Service and does not alter that period.
  7. After the end of the Hosting Service period, the User may order the preparation of a downloadable copy of the data stored as part of that Service and assigned to the Account, provided that the copy is still available in CBA.pl systems.
  8. The copy may include website files, databases and email contained in the available copy of the data stored as part of the Hosting Service. The copy preparation Service costs PLN 99 including VAT, and the completion time is up to 14 days from receipt of payment.
  9. Copies of data following the end of the Hosting Service period are retained for no longer than one year from the date that period ends. They are deleted after that time.
  10. If the User pays for the copy preparation Service before the end of the one-year period referred to in section 9, CBA.pl secures the available copy until it has been prepared and made available, even if the completion deadline falls after the anniversary of the end of the Hosting Service period.
  11. If CBA.pl determines that a copy is unavailable and the Service cannot be performed, it refunds the full price of the Service to the User.

X. Prices and payments

  1. Prices of Services offered by CBA.pl are stated in Polish zlotys (PLN), irrespective of the User's country of residence or registered office. Before placing a paid Order, the User is provided with the total price and information about all mandatory fees that can be determined at that stage.
  2. A change to the price list applies to new Orders and subsequent Service periods. Upgrades to Hosting Service parameters increase its price. The renewal price includes the cost of the plan and the upgrades that are to remain active for the next period. Before placing the Order, the User is informed of the total price payable. A change to the price list does not affect the price of the current period that has already been paid for. The fee for the next period is not charged unless the User places and pays for an Order.
  3. The available payment methods are presented in the Panel when the Order is placed. For CBA.pl, they may include:
    1. Przelewy24, operated by PayPro S.A.;
    2. PayPal, operated for customers from Poland by PayPal (Europe) S.à r.l. et Cie, S.C.A.;
    3. other methods expressly indicated before payment is confirmed.
  4. The User may be redirected to the payment operator's service in order to authorise the transaction.
  5. CBA.pl does not store payment instrument authentication data if it is entered directly into the payment operator's system.
  6. Once CBA.pl receives payment confirmation, the Order is accepted for processing. Depending on the type of Service, it may be activated automatically or require manual handling by CBA.pl.
  7. Payment is deemed to have been made when CBA.pl receives confirmation from the payment operator that it has been successfully completed. Processing of the Order begins after receipt of the full required amount has been confirmed and the payment has been assigned to the Order. If additional verification is required, the start of processing may be delayed until it is completed.
  8. CBA.pl is not liable for delays attributable exclusively to the bank or payment operator, but will provide the User with available information needed to clarify the transaction.
  9. Attempts to use another person's or an unauthorised payment instrument may result in the Order being put on hold, the Account being secured and the matter being reported to the relevant entities.
  10. Paid Services do not renew automatically. To continue using them, the User must order and pay for their renewal. CBA.pl does not charge renewal fees automatically.

XI. Consumer's right to withdraw from the Agreement

  1. A Consumer who has concluded a distance Agreement may, as a rule, withdraw from it within 14 days of its conclusion without giving any reason, subject to statutory exceptions.
  2. A withdrawal statement may be submitted through the ticket system or sent to obsluga@cba.pl. Sending the statement before the deadline is sufficient to meet it.
  3. The mere commencement of a Hosting Service, VPS or Additional Service before the deadline for withdrawal from the Agreement does not constitute full performance of that Service and does not automatically result in the Consumer losing the right to withdraw from the Agreement.
  4. When assessing whether the Service has been fully performed, the entire scope of performance specified in the Agreement is taken into account. In the case of a one-off Technical Service, this means completion of the entire agreed scope of work. In the case of a Service provided for a specified period, the mere exhaustion of the available limit of work or hours does not constitute full performance of the Service if CBA.pl remains obliged to provide other benefits during the remainder of that period.
  5. The Consumer loses the right to withdraw from an Agreement for a paid Service once it has been fully performed, provided that CBA.pl performed the Service with the Consumer's prior and express consent and, before performance began, the Consumer was informed that the right to withdraw from the Agreement would be lost upon full performance and acknowledged this.
  6. In the event of an effective withdrawal, CBA.pl refunds the payments received without undue delay and no later than 14 days after receiving the statement. The refund is made using the same payment method unless the Consumer has expressly agreed to another method.
  7. Except where a refund is required by law, CBA.pl does not refund fees for a successfully completed Domain registration or renewal due to the User changing their decision or ceasing to use the Domain. This provision does not limit the Consumer's statutory right to withdraw from the Agreement or claims arising from CBA.pl's non-performance or improper performance of the Service.
  8. Following effective withdrawal from an Agreement for a digital Service, the Consumer should cease using it, and CBA.pl may disable access to that Service.
  9. The provisions of this chapter do not limit any other rights of the Consumer arising from the Service's lack of conformity with the Agreement.

XII. Complaints and conformity of the Service with the Agreement

  1. The User may submit a complaint:
    1. through the ticket system in the Panel;
    2. to obsluga@cba.pl;
  2. Where possible, the complaint should include information enabling the User and the Service to be identified, a description of the problem, the date on which it occurred and the expected resolution. The absence of an element that is not necessary to examine the matter does not automatically result in the Consumer's complaint being rejected.
  3. CBA.pl responds to the User's complaint within 14 calendar days of receiving it. Failure to respond within this period has the consequences specified by applicable law.
  4. The response to the complaint is provided through the ticket system in the Panel or sent to the email address assigned to the User Account.
  5. CBA.pl is liable to the Consumer for ensuring that the digital Service conforms with the Agreement. If the Service does not meet the terms of the Agreement, the Consumer may demand that the non-conformity be remedied and, in the cases specified by law, a price reduction or withdrawal from the Agreement and a refund of the amounts due.
  6. Complaints concerning the payment authorisation process may require cooperation with the payment operator. This does not deprive the User of the right to submit a complaint concerning the Agreement directly to CBA.pl.

XIII. Suspension, termination of the Agreement and liability

  1. The User may discontinue use of the Service at any time. Discontinuing use before the end of the paid period does not in itself entitle the User to a refund, including for the unused portion of that period. This provision does not limit the Consumer's statutory right to withdraw from the Agreement or any other refund rights arising from applicable law.
  2. CBA.pl may suspend the Service or terminate the Agreement in the event of:
    1. non-payment after the payment deadline has passed and notice of the arrears has been given;
    2. a serious or repeated breach of the Terms of Service;
    3. unlawful use of the Service;
    4. a threat to the security or stability of the infrastructure;
    5. the provision of false information material to the Agreement;
    6. the implementation of a decision, order or obligation arising from law;
    7. permanent discontinuation of the Service, subject to the rules on prior notice and settlement of the unused period.
  3. In the event of an active threat, CBA.pl may suspend the Service immediately. Following suspension, the User has 48 hours to respond or remedy the breach. If that period expires without effect, CBA.pl may terminate the Agreement and delete the Service and its data. Specific rules concerning critically unlawful content are set out in Chapter VI.
  4. The suspension followed by deletion applies to the Hosting Service, including email, databases and copies of data stored as part of it, as well as to VPS. With regard to Domains registered by CBA.pl, CBA.pl may restrict the associated Hosting Services or DNS and fulfil the obligations of the relevant registry, but does not delete a Domain from an external registry without a basis in law or the registry rules.
  5. With regard to CBA.pl and j.pl subdomains, CBA.pl may suspend and subsequently revoke the User's right to use them. An SSL certificate may be revoked when required by security considerations or the applicable issuer rules. CBA.pl may refuse to perform a Technical Service or discontinue its performance. Restricting access to the Account does not in itself constitute deletion of the paid Services assigned to it. Deletion of each Service requires a basis in the Terms of Service or applicable law that relates to that specific Service.
  6. If a Service is blocked or deleted due to a breach of the Terms of Service, fees for the unused period are non-refundable, subject to rights that cannot be excluded.
  7. CBA.pl informs the User of the reason for restricting access to the Account, suspending the Service or terminating the Agreement and identifies the Services to which the decision applies. Information may be omitted only to the extent that providing it is prohibited by law or would create a legitimate security risk.
  8. After the Service ends, data may be permanently deleted in accordance with the deadline specified in the offer, Panel or termination notice. The User should download any required data before the specified date.
  9. CBA.pl is liable for non-performance or improper performance of the Agreement in accordance with applicable law.
  10. CBA.pl is not liable for:
    1. acts or omissions of the User and persons to whom the User has granted access;
    2. content, configurations or software introduced by the User;
    3. events beyond CBA.pl's reasonable control, the consequences of which could not have been prevented despite due care;
    4. failures of external services or networks for which CBA.pl is not responsible, subject to the obligation to take reasonable measures to mitigate their effects.
  11. Limitations of liability do not apply to damage caused intentionally, liability that cannot be excluded or Consumer rights arising from mandatory provisions of law.
  12. Planned technical work should be communicated with appropriate advance notice where its nature and circumstances allow. Emergency measures may be taken without prior notice.
  13. The User's inactivity alone does not constitute grounds for deleting the Account. This does not exclude the rules on suspending and deleting individual Services after their service periods end or for other reasons specified in the Terms of Service.

XIV. Amendments to the Terms of Service

  1. CBA.pl may propose an amendment to the Terms of Service for a justified reason, in particular in the event of:
    1. a change in law or a binding decision of a competent authority;
    2. a change in the Service Provider's or operator's details that does not affect the User's rights;
    3. the introduction, modification or discontinuation of a Service or feature;
    4. the need to prevent abuse or new security threats;
    5. a technical or organisational change affecting the manner in which Services are provided;
    6. the need to eliminate an ambiguity, error or provision that is no longer compliant with the law.
  2. Amendments to the Terms of Service should correspond to the reason for their introduction. New rules may apply to ongoing Agreements only to the extent permitted by law, taking into account the existing terms, fees paid and the User's rights.
  3. The notice specifies the content of the amendment, the reason, the effective date and the rights available to the User, including the option to terminate the Agreement if the amendment adversely affects an ongoing Service and the law provides such a right.
  4. CBA.pl reserves the right to amend the Terms of Service. Information about amendments is published on the CBA.pl forum and on the User Panel welcome page.
  5. Neutral or beneficial amendments, corrections of obvious errors and amendments concerning only new Orders may not limit rights under Agreements already concluded.

XV. Definitions

  1. CBA.pl or Service Provider - ABC Hosting Ltd. operating under the CBA.pl brand.
  2. User - a natural person, legal person or organisational unit using an Account or Service.
  3. Consumer - a natural person concluding an Agreement with CBA.pl that is not directly related to their business or professional activity, and a person to whom the law requires consumer rights to be applied accordingly.
  4. User Account or Account - an individual account created for the User in the CBA.pl system, enabling their identification and authentication, to which data, Orders, Services and communications with CBA.pl are assigned.
  5. User Panel or Panel - the part of the CBA.pl service available after login that enables the management of the Account, Services, Orders, payments and communications with CBA.pl.
  6. Service - a service provided by CBA.pl under the Terms of Service and an accepted Order.
  7. Hosting Service - making server resources and functions available to the User within the scope and plan specified in the Order.
  8. Domain - a domain name registered or maintained in accordance with the rules of the relevant registry.
  9. VPS - a separate virtual server environment with the parameters specified in the Order.
  10. Additional Service - a paid benefit, or a benefit included in a plan, associated with a Hosting Service, Domain or VPS, including SSL, administration or a Technical Service.
  11. Order - a declaration by the User specifying the selected Services and the terms presented in the summary before its approval.
  12. Agreement - an agreement for the provision of one or more Services concluded between the User and CBA.pl.
  13. .j.pl Subdomain - a name made available to the User in the j.pl domain owned by CBA.pl, which is not a separate Domain registered to the User in an external registry.
  14. .cba.pl Subdomain - a name made available to the User in the cba.pl domain owned by CBA.pl, which is not a separate Domain registered to the User in an external registry.

XVI. Final provisions

  1. The law applicable to the Agreement is determined in accordance with the applicable provisions. The choice of law may not deprive the Consumer of protection that cannot be excluded by agreement.
  2. The parties should first seek to resolve a dispute through the complaints procedure. This does not limit the right to refer the matter to the competent court or use out-of-court dispute resolution methods available under law.
  3. If any provision of the Terms of Service proves invalid or ineffective, the remaining provisions remain in force, and the invalid provision is replaced by the applicable provision of law.
  4. The following form an integral part of the contractual information:
    1. the offer and summary of the accepted Order;
    2. the current Privacy Policy with regard to information about data processing;
    3. the rules of the relevant Domain registry or registrar, where applicable.
